This course covers the basic themes surrounding the legal regulation of elections, politics, democratic process as a whole. Subjects covered include democratic theory, the individual right to vote and participate, the regulation of political parties and primary elections, the tension between majorities and minorities in the design of representative institutions, campaign finance, presidential elections, and alternatives to the traditional American approach for structuring electoral politics. This course offers a systematic exploration of the historical struggles related the structure of democratic institutions, the theoretical principles underlying differing democratic forms, and the way that law shapes the kind of democratic politics that we experience.
